Singer Madonna is heading back to court in Malawi on May to appeal a ruling blocking her from adopting three-year-old Mercy James.
A court in Lilongwe, capital of Malawi last April 3, 2009 denied the singer’s request for an interim adoption of the Malawi baby. The adoption bid failed because of the requirement that prospective parents must be a resident of Malawi for 18 to 24 months.
Madonna’s legal counsel lodged an appeal against the decision after receiving the court’s decision. Malawi’s Supreme Court has set a May 4 hearing to decide on the case.
Alan Chinula, Madonna’s lawyer is hopeful of a successful appeal as the initial rejection was based “on an archaic law of over 50 years ago.”
Madonna’s adoption of Malawian child David Banda, three, was made official last 2008 following two years of legal wrangling. She is also a mother to Rocco, eight, from her marriage to Guy Ritchie, and 12 year old Lourdes, from a previous relationship.
